Rental Income Tax in Brazil for Non-Resident Property Owners

If you are a Brazilian tax non-resident and rent out a property you own directly in Brazil, the rent is generally subject to 15% Brazilian withholding income tax, after the limited rental expenses the rules allow. A 25% rule can apply in favored-tax-jurisdiction situations, and any applicable treaty must be checked. The standard 15% is an income-tax rate, not a tax on the property’s value or a complete measure of every cost of ownership.

For non-resident rent, paying the tax and reporting it are separate jobs. The income-tax payment is generally due on the date of the taxable event, while the associated EFD-Reinf and DCTFWeb reporting follows its own timetable. Do not use a resident landlord’s Carnê-Leão schedule by default.

Brazilian rental tax for non-residents at a glance

This guide concerns rent earned personally from directly owned Brazilian property. A company, property fund, hotel pool or other ownership and operating structure needs a separate assessment.

First confirm that you are a Brazilian tax non-resident

Your nationality does not decide the rental-tax regime. A Brazilian citizen can be non-resident, and a foreign citizen can be resident. Holding a CPF or owning an apartment does not, by itself, settle your tax residence. Residence dates, immigration circumstances, presence in Brazil and any departure formalities need to be considered against the official residence criteria.

If you left Brazil, do not assume that the day you boarded a flight was automatically the start of non-resident taxation. Establish when residence actually ended and whether the departure communication and departure return were required. Also identify who is legally entitled to the rent. Joint ownership, an estate or a usufruct can change whose income must be assessed. The person whose bank account receives the transfer is not necessarily the person entitled to all of the rental income. How the 15% rental-income calculation works

For an ordinary case within the standard rule, the calculation is: gross rental income minus permitted exclusions, multiplied by 15%. Start from the tenant’s rent and the relevant payment records, not simply the net amount a property manager sends to your bank. The legal starting point is Article 763 of the Income Tax Regulation.

A low rent does not automatically produce zero tax under this regime. The resident income-tax table and the 2026 reduction for qualifying monthly income are not a general exemption for non-resident rental withholding. Keep the resident tax tables separate from the non-resident rule.

Which expenses may reduce the rental-tax base?

The exclusions are limited. They include the following categories when the relevant cost is borne by the landlord, properly supported and eligible under the rental rules:

Property taxes and qualifying charges: for example, an eligible IPTU property-tax payment relating to the rented property.

Condominium expenses: qualifying condominium charges actually paid, including ordinary or extraordinary condominium expenses where the conditions are met.

Collection and receipt expenses: qualifying real-estate collection or management commissions, including eligible rental-intermediation commissions. A manager’s entire invoice is not automatically one deductible commission.

Rent paid on a sublet property: relevant to a genuine subletting arrangement, not a fictional expense for someone renting out a property they own.

Do not deduct an amount twice or treat a cost borne by the tenant as though it were your own expense. Separate the rent, charges, reimbursements and commissions in the contract and statements before calculating the base.

There is no general deduction here for every expense that makes the property profitable. Mortgage repayments, financing interest, renovations, furniture, depreciation and utilities should not be subtracted merely because they relate to the property. Compare each item with the limited statutory exclusions. A cost that may matter when calculating a later property-sale gain is not automatically deductible against current rent. Worked example: R$6,000 of rent

Assume one directly owned apartment, one rent receipt and the standard 15% non-resident rate. The owner bears the following documented, qualifying costs, all treated as eligible for this calculation. No treaty adjustment or favored-jurisdiction rule applies.

Hypothetical illustration, not a client case. The arithmetic applies the standard rate and the statutory exclusions in Articles 42 and 763. It excludes foreign tax, other property costs, IBS/CBS, currency-transfer charges and any late-payment additions.

Who is responsible: the owner, tenant or property manager?

For rent from property belonging to a resident abroad, Brazilian rules assign withholding to the procurador, the owner’s appointed representative. Receita Federal’s current EFD-Reinf FAQ expressly assigns that representative the withholding, payment and EFD-Reinf reporting responsibilities. Its rental tables cover payments made by both individuals and companies. Income Tax Regulation, Article 781; EFD-Reinf FAQ, question 2.13.9.

Do not assume a property manager performs those tax tasks just because it collects rent. Ask who is formally acting as the representative, which services the agreement includes, and who supplies the tax-payment and filing receipts. The tenant, manager, representative and accountant should work from the same information about the owner’s status.

Before the first rent payment, agree on a practical workflow: who reports the tenant’s payment immediately, who confirms eligible costs, who prepares and pays the DARF, and who submits and reconciles the declarations. A monthly statement delivered weeks after collection is not, by itself, a workable same-day payment procedure.

If nobody has been appointed or the responsibility is unclear, resolve that arrangement rather than assuming the tax disappears. The ownership representation and the authorization needed to access Receita Federal’s systems also need to be aligned with the actual filing setup.

When is the tax due, and how does DARF 9478 work?

The official tax calendar lists code 9478 for relevant rent and leasing income of residents abroad, with payment linked to the taxable event occurring that day. The law covers amounts paid, credited, remitted, employed or delivered to the non-resident. Do not wait for the following month’s declaration deadline to consider the payment. A property manager holding the proceeds does not automatically defer recognition. For rental timing, Receita Federal treats the tenant’s payment to the real-estate administrator as relevant, regardless of when the administrator passes the money to the landlord. A later overseas remittance is therefore not a reliable substitute for the rental receipt date. IRPF questions and answers, question 210.

Whose CPF belongs on the payment?

The taxpayer identification used for the withholding obligation is not automatically the property owner’s CPF. In its individual-representative example, Receita Federal directs the procurador to pay DARF 9478 using the representative’s own CPF. The income beneficiary must still be correctly identified in the reporting. IRPF questions and answers, question 208.

Have the person preparing the filings confirm the correct declarant, identification, revenue code, period and beneficiary mapping before payment, especially if a company acts as representative. Do not copy a resident landlord’s DARF or change identifiers merely to make a bank payment go through.

EFD-Reinf and DCTFWeb: reporting is separate from payment

A paid DARF is not evidence that the associated declarations were submitted. EFD-Reinf reports the relevant income and withholding information, and the applicable information feeds DCTFWeb. The latter is used to declare the resulting tax liability. The representative’s non-resident-rent obligation is expressly described in Receita Federal’s EFD-Reinf FAQ.

The payment may be due before the monthly declaration process is completed. A useful illustration is the official calendar for August 2026 reporting:

If tax was paid before the monthly declaration, reconcile that payment against the subsequently declared liability through the applicable process. Do not pay the same tax twice simply because a balance or payment document appears later, and do not assume the first payment removed the reporting obligation.

Does the same approach apply to Airbnb and short-term rentals?

A short stay or a booking platform does not, by itself, remove rental-income taxation. First establish whether the arrangement is a direct property rental or a different accommodation, service or business model. Receita Federal’s rental guidance covers seasonal rentals as well as longer arrangements. IRPF questions and answers, question 209.

For a direct-rental arrangement, retain the platform’s gross booking and fee statements rather than only its net transfers. Eligible intermediation commissions must be distinguished from other expenses. Receita Federal also treats separately charged cleaning, parking, pet and similar fees as taxable receipts; a separate line on the invoice does not make them tax-free. Questions 209 and 445.

A hotel pool, services bundled with accommodation, or income received through a company should not be forced into this individual-landlord example. Ask for the contractual and tax classification before adopting a standard rate or deduction list.

A separate check: IBS and CBS under the tax reform

The rental income tax discussed here is not a complete assessment of the new consumption-tax system. The real-estate rules have separate tests for when an individual falls within the regular IBS/CBS regime. The 2026 amendments expressly refer to the individual eligibility limits in Article 251 of Complementary Law 214. Complementary Law 227/2026, amendments to Articles 252 and 253.

Have a reviewer check the scale and value of the operations, ownership and operating model, and the transition and reporting rules in force. Do not add a headline consumption-tax rate to every lease, or assume that paying 15% income tax resolves every other potential obligation.

Do non-resident landlords file an annual Brazilian tax return?

An individual who is non-resident throughout the relevant year does not file the ordinary resident annual adjustment return, the Declaração de Ajuste Anual, simply because they own or rent out Brazilian property. Receita Federal’s question 175 expressly distinguishes the non-resident position from resident filing thresholds. This is not an exemption from rental withholding and the associated reporting. A year in which residence changed requires a separate review, including any departure return and obligations relating to the resident period. Do not place all non-resident rent into a resident annual return merely because you have a CPF or previously filed one. Will my country of residence also tax the rent?

That depends on that country’s rules and any applicable relief. Do not assume Brazilian withholding is the only income tax, or that tax paid abroad cancels the Brazilian liability. What if rent has been received without the correct tax or reports?

Start by reconstructing the facts rather than paying an estimated annual amount. Organize the residence timeline, ownership records, lease, each tenant-payment date, gross rent, qualifying expenses, management statements, existing DARFs and any declaration receipts.

Ask the reviewer to separate three issues: unpaid or incorrectly paid income tax, missing or inaccurate declarations, and mismatched identification or payment allocation. A correction should address the original periods and the process that applied then, not simply add old rent to the current month’s figures.

Frequently asked questions

Is Brazilian rent tax-free if I receive less than R$5,000 a month?

Not automatically. The 2026 resident-table reduction is not a general non-resident rental allowance. The relevant starting rule remains 15% after permitted exclusions, subject to the exceptions described above. Non-resident rental rule; 2026 resident tables.

Can I keep the rent in Brazil and pay tax only when I send it abroad?

No, not as a general deferral strategy. The rental taxable event is not limited to an overseas remittance. Receipt through a property administrator can be relevant before the owner receives a later transfer. Income Tax Regulation, Article 763; Receita Federal, question 210.

Does hiring a property manager mean my tax is already handled?

Not necessarily. Confirm the appointed representative, the scope of the engagement and the actual payment and filing receipts. The official non-resident-rent guidance assigns withholding, payment and EFD-Reinf responsibility to the procurador. EFD-Reinf FAQ, question 2.13.9.

What happens if the property has two owners?

Identify each person’s entitlement to the rent and tax-residence status before calculating and reporting the income. Do not automatically allocate all income to the person who receives the bank transfer. Shared ownership, marriage-property rules and usufruct arrangements may require specific treatment. Is the tax the same if I sell the property?

A practical review should leave you with four clear answers: your tax-residence status, the person responsible for the withholding, a supported calculation for each relevant receipt, and proof that both payment and reporting are being handled.
